Flouted bail day it was imposed

A man who attacked his girlfriend and was then banned from contacting her flouted the special bail condition the day it was imposed.

As a result, 37-year-old Iain Donald, of Woolmarket, Alyth, was warned by Sheriff Lindsay Foulis he had now reached“the top end” as far as community payback orders were concerned.

He will have to complete 240 hours of unpaid work within the next six months and will be supervised for a year.

He admitted that on July 26, 2018, at his home, he assaulted his partner by pushing her on the body, causing her to fall onto a bed and holding her there.

He also breached the bail order on July 31, 2018 by entering the Woolmarket - just hours after it was imposed.

Solicitor Paul Ralph said the pair had been in a relationsh­ip for two-and-a-half years.

The special bail condition keeping them apart was subsequent­ly removed.

He had been texted by his partner telling him to come and collect his belongings.

Imposing the unpaid work, Sheriff Foulis told Donald:“It’s not up to your partner - or yourself - to say whether the bail conditions apply - it’s up to the court.

“Taking into account your previous conviction­s, you are now reaching the top end as far as community disposal. “But you are not there yet.” Prison would be next but the sheriff added:“You are not there yet.”
