Behind bars for bail breach in jail

For almost a month, a remand prisoner repeatedly flouted special bail conditions by contacting his partner from behind bars at Perth Prison.

Thirty-six-year-old David Lindsay sent letters and made numerous phone calls to Natalie Brown.

But they fell out and she contacted the police.

That led to him being jailed for four months at Perth Sheriff Court.

A three-year Nonharassm­ent Order was also imposed.

Sheriff Neil Bowie told him:”There’s no alternativ­e to a custodial sentence.

“You got into a position of repeatedly breaching court orders. You were on deferred sentence for a directly analogous matter and a community payback order for a directly analogous matter.”

Lindsay admitted breaching the June 10, 2020, order not to approach or contact the female between June 30 and July 28, 2020, at Perth Prison.

Depute fiscal Sarah Wilkinson said she began to receive letters from the accused at her previous as well as her current address.

“She also received phone calls from him at Perth Prison.”

A virtual visit had been arranged for August 5 but prior to that she had decided to end the relationsh­ip, added the fiscal.

She cancelled the visit and that led to an argument when he phoned to ask why it was not going ahead.

“She then contacted the police.”

A solicitor for the accused said communicat­ions between the pair had continued after the accused was remanded and there was “no suggestion”it was threatenin­g or abusive.

Lindsay had“wrongly” assumed the bail conditions did not apply after he was remanded.

She had access to her client’s bank account and there had been an argument over its use.

“He cancelled the card and it was after that she contacted the police about the breach of bail.

“The relationsh­ip is now ended,”added the lawyer.
