Dodgy GP barred from profession

- BY AMY FENTON

ADISGRACED GP has been permanently barred from the profession after he illegally prescribed medication for more than three years.

Dr Gary Tudor, who lives with his wife Jane in Rochdale, opened his private practice, Tudor Medical Matters, in Rawtenstall back in 2017 but failed to obtain registration with the Care Quality Commission (CQC).

The CQC received a complaint that Dr Tudor was practising without approval in 2018 and informed him that he was operating illegally.

However, Dr Tudor continued to see patients and prescribe medications.

CQC officers visited the Bank Street surgery in October 2018 where they saw a “waiting room full of patients” but despite being warned once more Dr Tudor, who previously worked at Pall Mall Medical in Manchester, continued working.

Following a lengthy Medical Practitioners Tribunal Service, Dr Tudor has now been permanently erased from the General Medical Council’s register; meaning he is no longer able to practise medicine. A total of 79 allegations made by the GMC were found proven during the MPTS hearing.

These include one in which a patient was wrongly diagnosed with hyperthyroidism - an overactive thyroid. This resulted in the patient being prescribed levothyroxine which led to them genuinely developing hyperthyroidism.

In its conclusions, the

MPTS panel said: “This is a serious case. This Tribunal has found proven 77 allegations which give rise to an ongoing impairment to practise medicine in Dr Tudor’s case.

“Tudor Medical Matters (TMM) opened in April 2017. The Tribunal has found that the surgery remained open to patients on a full-time basis until it closed in May 2020.

In the meantime, the CQC received a complaint in September 2018 that TMM was operating without registration in respect of the provision of regulated medical services.

In other words, TMM and Dr Tudor were not registered to see or treating patients.

“Dr Tudor was sent a letter explaining that he was therefore committing criminal offences. CQC visited the surgery in

October 2018, when its offices observed that the waiting room was full. Dr Tudor was again similarly warned about his conduct. He nonetheless continued to see and treat patients and to keep open the surgery.”

The MPTS panel found that Dr Tudor viewed his divergences from the rules as examples of ‘thinking outside of the box - of which he is proud’. The panel added: “Dr Tudor lacked any insight. It also bore in mind that the history of this case was littered with examples of Dr Tudor flouting attempts to regulate and/ or apply conditions to his medical practice.

“His misconduct was fundamentally incompatible with continued registration. In particular, the Tribunal was of the view that being honest with their professional regulator is the responsibility of every doctor.

“It recognised that erasing Dr Tudor’s name from the medical register means that he will no longer be able to practise medicine. In all the circumstances, the Tribunal reached the conclusion that erasure was an appropriate and proportionate sanction.

“The Tribunal determined that erasure was the only sanction that would be sufficient to uphold the statutory overarching objective, to protect patients, maintain public confidence in the profession, and uphold professional standards.”
