WHAT EFFECT HAS COVID-19 HAD ON ATTITUDES TO DIVORCE AND FAMILY MATTERS?
ANSWER: There has been much in the press about divorce rates rising as a result of Covid-19 and it is clear that some people are living in extremely difficult circumstances. At the same time it can be very difficult for people to access help at present, and personal safety must always come first. Unless the status quo is not safe, we would always counsel caution regarding any life changing decisions at this troubled time. In the event that a period of reflection does not assist, it can be helpful to take advice at an early stage in order that you can be made aware of options.
If a separation does prove inevitable, there are many positive forums for discussion, such as mediation, and collaborative law where parties agree not to go to court but instead roundtable discussions take place, assisted by lawyers who help guide conversations and offer legal input where required.
We are making far better use of technology, and videoconferencing can be used for consultations with clients, and to conduct mediation or roundtable discussions as required. We are also able to conduct court hearings remotely which has been a novel but welcome experience.
In relation to arrangements for children, the government has been very clear that lockdown restrictions do not apply in situations where children spend time in two homes, and those arrangements should carry on, unless there is concern about potential infection, or actual cases of coronavirus. As lockdown restrictions begin to ease, it is to be hoped that such arrangements can be implemented with less anxiety or concern than may be currently the case.
