Thug’s sentence wasn’t excessive
AVIOLENT thug who kicked and battered his expartner in the street is a “dangerous” offender who deserves every day of his sentence, judges ruled.
Mark McGinty, 36, subjected his ex, Jessica Hudson, to a savage attack outside her mother’s home in Kirkham, Lancashire, in May last year.
The Southport thug punched, kicked and stamped on her, before strangling her and holding a cloth over her face.
He told her he was going to kill her and Miss Hudson thought she was going to die.
McGinty, of Stourton Road, Ainsdale, near Southport, pleaded guilty to causing GBH with intent at Preston Crown Court last June.
He was sentenced to eight years and eight months, with another three years to serve on extended licence, last August.
He challenged his jail term last week but was told by Court of Appeal judges that he got the sentence he deserved.
The crown court judge considered McGinty posed a “high risk of serious harm” to ex-girlfriends, said Mrs Justice Lang.
And although the attack happened in particular circumstances, those circumstances could easily arise again in the future.
That could provoke him into a similar “excessive response”, putting others at risk of danger.
“The crown court judge was entitled to assess him as dangerous, even though he didn’t have a history of violence,” Mrs Justice Lang said.
“Neither the custodial term, nor the licence period, was manifestly excessive.”
The appeal was dismissed.
