Drunken behaviour terrified mum and ex

Former partner was so frightened she called police

A man who terrified his mum and former partner while drunk was this week ordered to undergo 12 months of supervisio­n.

James William Kelly, 31, of Princes Street, Stirling, pleaded guilty at the city’s sheriff court to threatenin­g and abusive behaviour at Achray Drive between December 2 and 3, and at Muirend Road on December 3.

Fiscal depute Ann Orr said Kelly at first turned up at his mother’s home at 5.30pm, where his behaviour was unpredicta­ble and intimidati­ng.

“She contacted police because he wouldn’t leave. He was warned off and asked not to return.

“But at 7pm he came through the back door, and started shouting and swearing at his mother and sister, then left the house.

“At midnight his mother was sleeping on the sofa and his sister was upstairs when they were woken by continuous knocking on the door. He shouted that he wanted to come in.

“They felt frightened and contacted police.”

The next day Kelly turned up at his former partner’s home, as she had her baby in the pram and was getting ready to go out. He was abusive towards her, and took her keys, going into her property. She was frightened so remained outside.

“He had his partner’s phone and somehow managed to dial his mother’s number.

“She could hear the accused shouting aggressive­ly, and his former partner saying ‘ You are frightenin­g me’.

“She became worried and alerted the police.”

The young woman took a walk around the block, but heard a loud smashing noise and returned to her home to find officers there, and her television and TV unit broken, as well as the door off her tumble drier.

Defence solicitor Alastair Ross said Kelly had been through a difficult relationsh­ip break- up and had two children with his former partner.

He added: “He understand­s the fear and alarm he caused and he’s full of regret.”

Sheriff Charles McFarlane sentenced him to a Community Payback Order, involving 12 months of supervisio­n, after hearing he wasn’t fit for unpaid work.

He said: “The grief you have caused your nearest and dearest was fairly significan­t.

“If the order is breached, you can expect to receive a custodial sentence.”
