Struggle left cop with suspected broken wrist

- Court reporter

A Thornhill man who left a police officer with a suspected broken wrist after a violent struggle outside a Stirling nightclub has appeared in court.

Iain Lindsay, 21, of Easter Frew Farm, admitted behaving in a threatening or abusive manner before resisting, obstructing or hindering police officers outside Fubar in the early hours of November 15 last year.

Stirling Sheriff Court heard how Lindsay became involved in a scuffle and was allegedly assaulted at around 3.15 am after a night out at the Maxwell Place club.

Fiscal depute Adrian Fraser said: “Police witnesses who were asked to monitor people leaving Fubar saw a fight in the road involving a group of people including the accused.

“The accused and another person were seen to throw punches. Security tried to separate them. Police ran over to give assistance and asked other officers to attend.

“One officer took the accused away to talk to him. He appeared to be intoxicated. His speech was slurred and he had cuts on his knuckles.”

The court heard how Lindsay failed to give details about the incident before saying: “Just arrest me now. You would know who I am and what I could do if you knew me.”

He refused to calm down and continued to shout. He said to the officers he was going to “escalate things” and told them to “f*** off”. When he said he was “going to the taxi rank to sort them” he was arrested.

Mr Fraser continued: “As the handcuffs were being placed on his wrist he began to struggle to prevent them from being applied.”

One officer was said to have been left with a “suspected” broken wrist after the struggle. Lindsay was cautioned and charged.

His defence solicitor said: “He was assaulted outside the club. He had a bit to drink and he regrets his actions and apologises.

“He is a young man with one previous offence. Not someone who often gets in trouble.”

Sheriff Wyllie Robertson replied: “He might have been assaulted but his behaviour was such that a police officer had a suspected broken wrist.

“I am going to call for reports but this was behaviour of a violent nature. I want to know more about the officer’s injury and if he was off work and how long for.

“All options are available here – this is a serious matter.”

Lindsay was ordered to return to court on May 18.
