Court hear booze played part

A boozed-up Killin man who caused a disturbanc­e at a restaurant in the village has been ordered to complete unpaid work.

Martin Gillespie, 26, uttered abusive comments while in the Capercaill­ie on Main Street on January 16.

And just hours later the Fingal Road resident shouted, swore, struggled and engaged in a fight with a man on the same street – committing a breach of the peace.

The court heard how Gillespie’s behaviour on the evening was spontaneou­s rather than pre-planned and involved visitors to the area – so people he didn’t know.

His defence solicitor said: “Alcohol did play a part and based disposal could “bolster what has been a stable period in his life”.

Sheriff Robertson said to Gillespie: “The problem you have is that this behaviour that night comes against your record for violence.

“I don’t know how much you have looked into this but the extent of your record might be an impediment in your hopes of going to America – but that’s another matter.

“Custody has to be considered in matters such as these, but I am prepared to consider an alternativ­e.”

Gillespie was ordered to undertake 200 hours unpaid work in the next 12 months.

Sheriff Robertson added: “This is an alternativ­e to custody.

“If you breach the order you will be brought back and custody will likely be imposed.”
