Crash driver refused to take drinks test

A Tullibody man whose careless driving led to a crash on the A82 has been banned from the roads.

John Brown (38) suffered a broken collarbone in a smash on a stretch of the road between Crianlaric­h and Inverarnan on November 18.

The Carseview resident also failed to provide a specimen of blood after being taken to Royal Alexandra Hospital in Paisley for treatment.

Stirling Sheriff Court heard on Wednesday that at around 3.30pm on the day of the accident Brown was seen overtaking at an inappropri­ate section, causing him to leave the road and crash.

Other motorists who stopped and went to assist Brown could smell alcohol on him. Emergency services were called and he was rushed to hospital, where he failed to give a blood sample.

When he appeared for sentencing on Wednesday Sheriff William Gilchrist told him:“Although you were the only person injured the charge of careless driving comes as a result of you being under the influence of alcohol. As you refused to provide a blood sample we don’t know what that level was.”

Brown was ordered to do 80 hours of unpaid work, fined £300 and banned from the roads for 20 months.

Sheriff Gilchrist added:“You understand that if you don’t comply with this you will be brought back to court.”
