Woman denies breath test charges

A Stirling woman has denied three charges relating to a road traffic matter in a St Ninians street.

Pauline Young, of Murrayshal­l Road, pleaded not guilty to charges of failing to cooperate with a preliminar­y breath test and failing to provide the identity of the driver of a car, all on Saturday October 17, at an address in Earlsburn Avenue, as well as failing to provide two specimens of breath at Falkirk Police Office.

The complaint alleged that Young had been the keeper and driver of a car and had been alleged to be guilty of an offence contraveni­ng the Road Traffic Act 1988 which had occurred about 7.30pm in Earlsburn Avenue. She is said to have failed to give police informatio­n about the identity of the driver of the vehicle, failed to cooperate with a preliminar­y breath test while unfit to drive – having alcohol or a drug in her body –and failing to provide two specimens of breath for analysis through a device to ascertain her ability to drive.

Her lawyer told Stirling Sheriff Court last week that the 29-year-old pleaded not guilty to all three charges and was seeking bail which the fiscal depute did not oppose.

The defence solicitor also pointed out that Young accepted that she is the keeper of the vehicle concerned, but disputed being the driver.

Sheriff William Gilchrist set the trial date for March 10, with an intermedia­te diet of February 16, and granted bail with standard conditions.
