COSTLY ARGUMENT
MY father died three years ago, leaving me and my nephew as beneficiaries of his will. Since then my nephew has been locked in an argument with the solicitor who drafted the will, whose fees are steadily rising in the meantime. How can I get them to resolve the matter? WHAT you can do, if anything, depends on what the dispute is about, and whether your brother is a sole executor of your father’s will. If he is the sole executor there is not much you can do. If you are joint executors you have a right to know what this dispute is about. If you cannot persuade them to agree, then you could apply to the court for directions as to what is to be done. These applications can be very expensive, and as beneficiaries, both you and your nephew would lose out as the legal costs come from the estate. The other alternative is to offer mediation to see if an agreement can be reached.
