Restraining order breach by eating pizza in mam’s house
A homeless son banned by a court from seeing his mum slept in a storage box in her garden and ate pizza in her home while she was out.
Cain Lebiman ,19, was invited into the property in West heath Avenue, Grangetown, Sunderland, by the woman’s daughter out of pity for his plight.
She opened the door to Lebiman, of no fixed abode, to get fed and warmed after a prison release left him with nowhere to live, a court heard.
But his mother Leslie Veator found out and contacted police, not out of fear but in the hope of getting him support to find accommodation.
Prosecutor Robert Lawson told South Tyne side Magistrates’ Court Lebiman breached the restraining order on Thursday, October 22.
He added :“Mrs V eat or has in the past five weeks started living at her partner’ s house, and let her daughter have her address.
“She was told about five days ago that he started sleeping in a storage box outside the property.
"He was not supposed to be there due to a restraining order.
“He was released from prison, with no abode. His mother did feel that she was forced to contact Probation, due to concerns, and she contacted the police.
“A Pc Aichison attended the address, and the defendant was at the property. He had been let in by the daughter to have some pizza and to warm up.
“He has pleaded guilty. It’s a deliberate breach, he does seem to do so out of desperation.”
The court heard Lebiman was banned from contacting Ms V eat or or going to her home under the terms of a restraining order, imposed on January 20.
Joanne Ga tens, defending, said :“He went to the address when he knew that his mum wasn’t there so as to cause as little disruption as possible.
“He had been invited in for heat, for a drink and for pizza, and he intended to go back out to the storage box.
“Out of sheer desperation he is staying in a storage box. This is a young man who is absolutely desperate.”
Deputy District Judge Alex Boyd sentenced Lebiman to a six-month condi ti on al discharge–and warned him not to reoffend.
Lebiman must pay a £22 victim surcharge.
