Accused denies grabbing man by throat after walking in on sex tryst

A man has told a court he feared he might “die” as he was attacked during an alleged assault.

The male accused Jean Esingle, 32, of seizing him by the throat after the accused allegedly sexually assaulted two women at a party.

Esingle is alleged to have sexually assaulted the women on October 31 last year in Dundee.

The three complainer­s had been engaged in a consensual sexual act when Ensingle entered.

Legal orders mean none of them can be identified.

One woman gave evidence at Dundee Sheriff Court yesterday and described how she, the male and the other woman were involved in an intimate and consensual act following a house party in the city.

She claimed Esingle entered the bedroom where all three were entangled “with the intention of becoming involved”. The male complainer had said during his evidence that Esingle had approached the women from behind while exposed.

The female witness said: “I froze up. (The man) recognised I was distressed.

“Esingle was behind me. (The man) told him to stop and it wasn’t happening.

“Esingle then progressed to shouting and told (the man) he could ‘do what he wants’ and then he grabbed (the man) by the throat.”

When it was suggested during cross-examinatio­n Esingle was only in the room and touched one of the complainer­s to collect a jacket, the male complainer said: “With his p **** out? No.”

The Crown asked what the man meant by his statement claiming he felt he would “die”.

He said: “What happened that night was as close as I could imagine to what it would be like to be raped. I did think I was going to die that night.”

Esingle, of Whitehall Crescent, Dundee, denies two charges of sexual assault against the two women and another of assaulting the man by squeezing his neck until he struggled to breathe.

The trial was adjourned until December 8.
