Window sex act man avoids jail sentence

Accused also possessed child abuse images and was assessed by police as high risk

Two former friends of a Dundee man unmasked as a serial pervert say they fear he will offend again.

Jamie Mullen escaped a jail term yesterday after admitting performing a sex act at his open window in front of a “distressed” passing woman and possessing child abuse images.

A sheriff instead handed down a three-year community payback order and a 10-year sexual offences prevention order, a condition of which forbids Mullen from any contact with a lone female of any age during that time.

Following the case, his former friends Kym McNiven and Ffyona Macleish revealed how they turned detective to uncover Mullen’s online activity after he bragged about dodging justice.

Ms Macleish said: “He had been arrested over the stuff at the window and he came and told us about it really smug, saying ‘they’ll never prove it’. “So that got us wondering. “He’s a repeat offender already. We knew nothing about his past.

“He’s got 10 years to not breach it, but I think he’ll be back.”

Ms McNiven said: “He sent me an email with an address I didn’t recognise, so Ffyona looked it up and there was a list of porn sites and three or four had his picture on the profile so she knew it was him.

“We were totally and utterly disgusted because we classed him as a friend.

“It was just vile, our immediate response was to go to the police.”

A number of the videos they found with Mullen’s profile picture showed a male performing a sex act at a window.

Dundee Sheriff Court heard that Mullen, who was kicked out of the armed forces after being jailed for possessing child abuse images in 2006, was seen naked from the waist down with a hood covering his face by the “distressed” passer-by.

The 30-year-old, who the court heard is assessed by police as a high risk of serious harm to others and is already on the sex offenders register until 2021, was also caught with indecent pictures of children when police raided his Cowgate flat last summer.

A micro sd card also found revealed a self-taken video of an adult male performing a sex act at an open window while an unknown woman walked past the property.

A total of 41 indecent images of children aged between three and 15 were also discovered.

Mullen, of Cowgate, admitted intentiona­lly exposing his genitals in a sexual manner to unknown persons and carrying out a sex act at an open window at Cowgate between February 9 2013 and May 19 2014.

He also admitted possessing indecent photograph­s or pseudo-photograph­s of children between June 14 and July 22 last year.
