Fort sex offender also ordered to do 100 hours’ unpaid work

A Fort William man who was placed on the Sex Offenders’ Register was back in the town’s court this week to hear the rest of his sentence.

Kamil Borowka, 34, of High Street, Fort William, was placed on the Sex Offenders’ Register when he appeared in court last month after admitting touching two women in a town pub in August.

The two offences occurred in a bar in the town’s High Street on August 19 and was recorded on its CCTV security camera system.

Borowka had been drunk at the time of the offences, which involved rubbing his hand over one woman’s back and bottom, over the top of her clothing, and squeezing the bottom of another also over her clothing.

Sentence had been deferred until this week for compilatio­n of a criminal justice social work report – although Sheriff Gary Aitken had immediatel­y placed Borowka on the Sex Offenders’ Register.

This week Borowka appeared in front of Sheriff Eilidh MacDonald, who heard defence agent Hamish Melrose explain in mitigation that his client could remember very little about the incident due to the level of intoxicati­on.

‘But when these events were explained to Mr Borowka and he was made aware of the witness statements, he acknowledg­ed his guilt which meant there was no trial needed that would have necessitat­ed the complainer­s having to come here,’ said Mr Melrose.

‘This has already had an effect as his employment in a local supermarke­t, which was ended following the publicity. He now works in Mallaig.’

Sheriff MacDonald told Borowka these had been serious charges: ‘Taking into account the circumstan­ces and listening to what Mr Melrose has said, as well as the criminal justice social work report and a second report, I will deal with this by way of a community payback order as a direct alternativ­e to custody.

‘There will be a period of supervisio­n for six months and you will also do 100 hours of unpaid work,’ she said, adding that his placement on the Sex Offenders’ Register will last six months as from Tuesday of this week.
