UNUSUAL CASE
Rose Senior, married woman, North Street, York, was summoned by her husband, Albert Senior, general dealer, who applied for a discharge of a maintenance order, the ground being that she had resumed cohabitation. Mr Whitfield appeared for the husband, and Mr Crombie, of York, for the wife. Mr Whitfield said a maintenance order at the rate of 15s a week was made by the Scarborough Magistrates on 29th June, brought at the request of Mrs Senior.
The parties lived apart, and the order was duly observed until the end of September, when following a casual meeting in Scarborough the parties came together again, and lived together at York for nearly three months. Senior gave evidence in support of this statement. Mr Crombie, in outlining the case for Mrs Senior, said although it was admitted that Mrs Senior had returned to York for a time and that they had occupied the same building he was going to endeavour to show that there had been no return to cohabitation. Further, Senior had paid the maintenance money and only a fortnight ago was perfectly wiling to continue to do so. He never suggested that cohabitation had been resumed.
Mrs Senior, in reply to Mr Whitfield, admitted that for a fortnight she got on with her husband at York fairly well. The magistrates retired, and on returning the chairman (Mr J Dippie) said the case had presented difficulties. It was common ground that the parties had voluntarily lived together, and for the first fortnight lived on amenable terms.
As Mrs Senior had resumed cohabitation, the order would be discharged.
