Yes we can go?

The UK can unilaterally revoke its withdrawal from the EU, according to a European Court of Justice advocate general’s legal opinion. Manuel Campos Sanchez-bordona rejected the contention Article 50 only allows the possibility of revocation following a unanimous decision of the European Council.

They can start printing the No Deal or No Brexit referendum ballots. Because that is now where things are headed.

Kampunghighlander

Everyone knows that Brexit will be cancelled. Only the daft and racists still want it.

Frog jobbies

Article 50 says nothing about rescinding notification of withdrawal from the EU. But if it requires unanimous consent merely to extend the two-year period, how can it be interpreted as giving a unilateral right to scrap

the process altogether?

Toosh Extending the departure date isn’t the same as cancelling it.

Splat Z The comment merely confirms what Brexiteers always knew, which is that the UK is a sovereign state and can freely go its own way, stay in or drop out.

There is no mechanism for an extension of article 50, the judgement covers the withdrawal of article 50 and there are criteria attached to the ability to withdraw.

Roastin

The EU leaders have made it clear they would agree to an extension. There is time. Let’s hold a vote on the facts where both side respect the law.

It’s OK to cancel democracy?

Big Scotlander

There was no democracy in the 2016 vote. Up to a million British citizens were denied the vote and both Leave organisations broke electoral law, for which they have been convicted and fined. More than enough reason to void the result and hold Euroref2!

George Kelly Firstly, the statement is one man’s opinion, not the definitive judgment of the court. Secondly, take careful note of the clause “provided that the revocation … does not involve an abusive practice”. Now any move to withdraw the request to leave the EU would constitute the flagrant disregard of the will of the electorate. And this would certainly constitute an abusive practice. So the advocate general has, in effect, contradicted himself and ruled out the possibility of unilateral revocation.

Reality Demands To Be Heard As, legally, the referendum was only advisory in the first place, it wouldn’t be abusive practice.

Dunnomuch Cancel a majority decision to ensure the minority win! LOL! Good luck with the future and freedoms and civil liberties Britain. What that would do is render all future referendums pointless –including a Scottish one.
