Why it is the ideal time to get a Power of Attorney

A limited time offer for the vital document you need to protect your home... and your family

- WORDS LAURA COVENTRY

Prices are rising everywhere we look – but it has never been more affordable to organise your Power of Attorney.

That’s because, for a limited time only, ILAWS Scotland is arranging this essential legal document for the discounted rate of £192, which is a 20% saving!

So far, many many people have taken advantage of the reduced cost of setting up a Power of Attorney and, in doing so, have looked after their welfare when (or if) the time comes, and a POA is needed.

Often people assume that their next of kin will be the person to make important decisions for them about their treatment and care when they are admitted to hospital – but this is not the case.

Tony Marchi, principal at ILAWS Scotland, explained: “People still think their husband, wife, son or daughter can make decisions, but they can’t. Our clients have told us that when they go into hospital they are asked ‘do you have Power of Attorney?’ not, as many assume, ‘who is your next of kin?’.

“If you have thought about organising a Power of Attorney, then now is the time to get this done because of our 20% discount, which will be running for a limited time only. take advantage of this and get this vitally important document draw up for this special rate while you can.”

Did you know you can name more than one person as your attorney? In fact, tony Marchi explained that it is sometimes beneficial to have two (or more) as attorneys. Doing this will give you peace of mind and reassurance that two (or more) trusted people will be looking after your medical decisions or financial affairs.you can nominate a “principal” attorney and a “substitute” attorney, or have two attorney with “joint” responsibilities.

Also, people are sometimes a little hesitant in “giving power” to someone else, especially when it comes to accessing bank accounts and finances.

However, as Tony explained, it’s not about giving away power: “it’s the opposite.you are taking control by ensuring whomever you appoint is your choice and this does not end up with someone you wouldn’t want or someone you don’t know.”

And you don’t have to worry about anyone running away with your savings that you have built up over the years.

He added: “it is worth noting that there are all sorts of checks and balances in place – so no one can walk away with your money if you give Power of Attorney.

“It is always controllable. “Once your Power of Attorney is registered with the Scottish Courts (which costs an additional £81), it will go to your bank and they will then speak to you about how it will work.you could also request for your bank to notify you when someone withdraws money from your account; you could put a limit on the amount withdrawn; or you could give full control to your attorney to withdraw any amount.

“Essentially, you can set it up the way you want it to run.”

How else could a Power of Attorney benefit you? If, or when, you go into a care home, a Power of Attorney also comes into play. they can decide how you will be looked after, right down to how you will dress to insisting you have your false teeth put in.the attorney acts as if they are you in certain circumstances.
