The Sunday Post (Inverness)

Time is running out to get vital legal documents at special rate

- By Laura Coventry news@sundaypost.com

The end of the year is the time when we reflect on the previous 12 months and celebrate what we have achieved. It is also a time to remedy the things we should have done, before the year is out.

If you are one of the many Scottish homeowners to put off writing a Will, arranging Power of Attorney or protecting your property from care home fees, then read on. You are not alone, as these essential legal documents are often put on the to-do list, but sometimes arranging them never comes to fruition.

If you really meant to get your financial affairs in order in 2022, but simply never got around to doing it – don’t worry, there is still time.

The main reason to make these arrangements now – and join the countless other happy clients of ILAWS Scotland – is for your peace of mind.

Once your Will is written, your wishes will be carried out when you are no longer here. Once your Power of Attorney (POA) has been set up and approved by the Scottish Courts system, your wishes will be carried out when you are still here.

That’s because a trusted member of your family will make decisions for you, on your behalf as you would, when you may have lost capacity or are too unwell to make them.

Having to sell your property to pay for care home fees is also possible. However, you can prevent this from happening as there are legitimate ways to keep you property in your family – and this is a service ILAWS is proud to offer. Is it not time to find out if you and your family might be able to benefit from a Trust or a Transfer?

Tony Marchi, principal at ILAWS, understands why people do put off arranging Wills, POAS and property transfers, as they assume it will be a daunting experience, perhaps explained to them in language they cannot understand – but not if you book your appointment with ILAWS.

Tony said: “If you have thought about arranging these documents before, then consider doing it now. Is it worth just one hour of your time?

“With expected price increases in January, this is your last opportunity to take advantage of the discounted rate for arranging your Power of Attorney.

“If you book an appointment before the Christmas shutdown, we can come and visit you in your home, or invite you to one of our offices near you. The appointments will only take an hour and everything discussed will be explained to you clearly so you can understand.”

If you need another reason to make these arrangements, then here it is: ILAWS is offering a discount on Power of Attorney to Sunday Post readers who get in touch and book an appointment before the Christmas break. The price of arranging a POA is usually £240 (plus £83 Scottish Court registration fee, totalling £323), but with ILAWS’ discount, you will only pay £192 (plus £83 Scottish Court registration fee, totalling £275). But this discount is for a limited time only and the price is expected to increase in January 2023.

So, if you really wish you had put a POA in place during 2022, you can still tick it off the list before the year is out.

Tony added: “Just think, if you arrange your Will, Power of Attorney or protected your property, you will have peace of mind, and then you can concentrate on making more fun resolutions for 2023!”
