QPro­vided that there’s no ob­jec­tion from neigh­bours, can any­one keep a few chick­ens in their gar­den? My part­ner and I are buy­ing our first home to­gether and, much en­cour­aged by read­ing your mag­a­zine, would like to re-home three or for ‘res­cue’ hens.

AJeremy Hob­son says: In most in­stances it’s pos­si­ble to keep chick­ens in the back gar­den but it is best that you seek the ad­vice of the so­lic­i­tor han­dling your house pur­chase as, buried in the small print could be what’s known as a ‘re­stric­tive covenant’ which might po­ten­tially pre­vent you from do­ing so.

Many such clauses go back years and if one ex­ists, it could be pos­si­ble to make an ap­pli­ca­tion seek­ing an or­der to ‘dis­charge’ or ‘mod­ify’ the re­stric­tion. It’s not nor­mally a quick process though – and will ob­vi­ously cost money.
