100 YEARS AGO Tables turned in court
An unusual session began in State Supreme Court in Albany when the plaintiff and defendant switch places. Panzieri-Hogan Co. contractors, had brought an action against Harry S. Bender for breach of contract, but the case changed to Bender suing the contractors for $2011.17 Bender alleged was lost through rent deductions due to the failure of the contractors to finish alterations to two of Bender’s properties on time. A third party had leased the properties, but the only collected half of the rental fees until the premises were ready for occupancy, adding to the amount Bender said he was entitled to. Panzieri-Hogan argued the delays were due the strike of the trades unions and covered under a strike clause.
