Suspect is put on most-wanted list

Ojeda has been running since he was charged in infant’s 2019 death

A Cohoes man who has been on the run since he was charged in the 2019 homicide of his infant son has been added to the U.S. Marshals’ mostwanted list.

The marshals added Anthony Ojeda, 40, to the agency’s 15 Most Wanted Fugitives list. Ojeda and his husband, 32year-old Neil Garzon, have been on the run instead of appearing at hearings on their alleged roles in the death of Ojeda’s 6-week-old son, Eli Harmon Ojeda, on Dec. 3, 2019, in the couple’s Van Vechten Street apartment.

Ojeda has also been known as Erik Jonathan Donas-ojeda.

Ojeda and Garzon were indicted by an Albany County grand jury after Ojeda withdrew his original guilty plea to second-degree manslaught­er, claiming that Garzon was responsibl­e for the infant’s death.

The boy died shortly after arriving at Albany Medical Center Hospital. He had injuries to his ribs and head and appeared to have overdosed from ingesting methamphet­amine, according to authoritie­s.

Ojeda filed to appear for a scheduled court appearance on Aug. 24, and authoritie­s later said that he and Garzon were on the run to avoid prosecutio­n.

“The U.S. Marshals will bring every necessary resource to bear to see that Anthony Ojeda answers the charges regarding baby Eli’s death,”

Ronald L. Davis, director of the Marshals Service, said in a statement. “Our sincere hope is that someone with relevant informatio­n will do the right thing and tell law enforcemen­t where Ojeda is hiding, so we can arrest him safely and bring some closure to this community. Justice must be served.”

Ojeda and Garzon are believed to be together and getting assistance from family members and associates. They were last seen in August driving a black Nissan Sentra with the Indiana license plate FL905AAR.

Ojeda and Garzon are both approximat­ely 5 feet 5 inches tall. Ojeda weighs 145 pounds and Garzon weighs 175 pounds.

The Marshals Service is offering a $25,000 reward for informatio­n leading directly to the capture of Ojeda. Anyone with informatio­n about Ojeda’s or Garzon’s location is asked to contact the nearest Marshals Service district office, or to submit a tip through the USMS Tips App or by calling 877WANTED2.
