Albuquerque Police Department officers have made an arrest in the fatal stabbing of a man near a convenience store in Southeast Albuquerque on Friday morning.

Tyrone Benito, a transgender woman who goes by Beverly or Bev, is charged with murder and tampering with evidence and was booked into the Metropolitan Detention Center on Saturday.

According to a criminal complaint, Benito stabbed Jack Kyselka across the street from the 7-Eleven convenience store at San Mateo and Kathryn around 4:30 a.m. Friday following an argument.

Kyselka, after being stabbed, then crossed the street to the 7-Eleven. An employee of the store called 911, but Kyselka was pronounced dead at the scene.

An autopsy report concluded that Kyselka died from a stab wound to the chest that punctured the heart. He also had cuts to his face, hand and feet.

Benito said she stabbed Kyselka after Kyselka took a backpack containing Benito’s belongings from her boyfriend, Michael Miller.

Miller told police that he told Benito about the backpack and she “became upset and grabbed a kitchen knife.”

Benito and Miller left the apartment to find Kyselka and confront him, according to the criminal complaint.

According to Benito’s statement, when she confronted Kyselka, he said several slurs back to her.

She then “sliced Jack’s foot, then his chest.”

Benito told police that she searched Kyselka’s belongings for her backpack after he fled the attack.

She said she also disposed of the clothing she was wearing and the knife she used to stab Kyselka.
