3 charged after 1 allegedly fired gun toward ABQ police
Three young men are behind bars after police say one of them fired a gun toward a police sergeant early Saturday morning in Northeast Albuquerque.
Bodhi Lamariana, 18, the alleged shooter, is charged with shooting from a motor vehicle and aggravated assault with a deadly weapon.
Josiah Herrera, 19, and Jonathon Rosales, 20, are each charged with conspiracy to shoot from a motor vehicle.
All three were booked into the Metropolitan Detention Center. It is unclear if any of the men have an attorney.
Police said the sergeant identified Lamariana as the shooter by the white shirt he wore and the seat he was in.
Around 1:30 a.m., the sergeant was in his marked unit when he heard yelling, and then gunfire, coming from a vehicle near Eubank and Menaul, according to a criminal complaint filed in Metropolitan Court. The sergeant followed the vehicle from a distance when someone pointed a gun out the passenger window “at him” and fired.
Police said the sergeant swerved to avoid being shot and turned on his lights and sirens as he followed the vehicle onto Interstate 40. The vehicle drove slowly on I-40 and got off at Wyoming before stopping at a gas station.
The sergeant detained Lamariana, Rosales and Herrera, who all smelled of alcohol, according to the complaint. The officer found three guns, two with an extended magazine and laser sight, in the vehicle, along with bullet casings.
Both Lamariana and Herrera declined to speak with police. Rosales told police they were leaving Silva Lanes and were speeding before they got pulled over, according to the complaint. Rosales declined to name who fired a gun but said Lamariana and Herrera both have guns, adding “they do that (expletive) all the time sir.”
Police said due to the sergeant’s eyewitness account and where the bullet casings and guns were in the vehicle, they believed Lamariana fired the shots from the passenger’s side.
