An all-weather perimeter patrol road would be constructed along the interior of the fence. The patrol road would include gravel and paved segments. e. Exelon Generation Corporation, LLC (Exelon) filed a Joint Offer of Settlement and Explanatory Statement (Settlement Agreement) on behalf of itself and the Maryland Department of the Environment (MDE). The Settlement Agreement provides for the resolution of all issues between the signatories associated with MDE’s issuance of a water quality certification for the project pursuant to section 401 of the Clean Water Act (certification). The Settlement Agreement includes proposed protection, mitigation, and enhancement measures to address ecological, recreation, and water quality resources affected by the Conowingo Project. The Settlement Agreement also includes, conditioned on the Commission’s approval of the Settlement Agreement and incorporation of proposed articles in a new license, a waiver of MDE’s certification, and withdrawal of Exelon’s February 28, 2019, petition for declaratory order regarding MDE’s certification. Exelon requests the Commission approve the Settlement Agreement and incorporate the proposed license articles set forth in Attachment A of the Settlement Agreement, without modification or expansion, into a new, 50-year license for the Conowingo Project. The EPA regulations ( 40 CFR PART 122.62) and current permit conditions (see PART VII.E.1, Permit Revocation and Modification) allow for NPDES permits to be modified for an appropriate cause. MDOT SHA officially requested a modification of its current permit (Discharge Permit Number 11DP-3313 MD0068276) on February 13, 2019, to allow the use of nutrient trading to meet the 20 percent impervious surface restoration requirement by the end of the current permit term (i.e., October 8, 2020). MDE has determined the use of nutrient credits by MDOT SHA for meeting the 20 percent impervious surface restoration requirement is acceptable. Therefore, MDE hereby adds a new paragraph that allows for nutrient trading to meet this requirement in PART IV.E.3; and renames the original permit’s PART IV.E.3 and PART IV.E.4 as PART IV.E.4 and PART IV.E.5, respectively. This EA evaluates the potential environmental effects that may occur as a result of the Proposed Action, and will be prepared in accordance with the National Environmental Policy Act (NEPA) of 1969, as amended. Based on the EA, the Army has determined that implementation of the Proposed Action would have no significant adverse direct, indirect, or cumulative effects on the quality of the human or natural environment. Therefore, at the conclusion of the public comment period, it is anticipated that a Finding of No Significant Impact (FNSI) would be appropriate and would be signed for this project. k.
