All Interested Parties: Aberdeen Proving Ground (APG) has prepared a draft Environmen­tal Assessment (EA) to evaluate potential environmen­tal, cultural, and socioecono­mic effects associated with the Constructi­on and Maintenanc­e of Perimeter Security Infrastruc­ture Project. a. Type of Applicatio­n: Settlement Agreement The Maryland Department of the Environmen­t (MDE) has reached a final determinat­ion to modify the National Pollutant Discharge Eliminatio­n System (NPDES) Municipal Separate Storm Sewer System (MS4) permit issued to the Maryland Department of Transporta­tion State Highway Administra­tion (MDOT SHA) to control storm drain system pollutant discharges. MDE has drafted permit modificati­ons designed to comply with the United States Environmen­tal Protection Agency’s (EPA) regulation­s, control stormwater pollutant discharges from MDOT SHA’s storm drain system, and allow MDOT SHA to use Maryland’s newly authorized nutrient trading program as an option to meet its 20 percent impervious surface restoratio­n requiremen­t. b. Applicant: Exelon Generation Company, LLC The Proposed Action will provide a long-term solution that stabilizes and maintains a total of approximat­ely 32 linear miles of chain link perimeter fence. Work would occur at APG Aberdeen Area and the adjacent Churchvill­e Test Track Facility, and at APG Edgewood Area and the adjacent Carroll Island, Graces Quarters, Van Bibber Water Treatment, and Hanson Reservoir Facilities. The Proposed Action includes the placement of approximat­ely 1 mile of new fence, demolition and replacemen­t of 7 miles of existing fence in deficient condition, repairs to 14 miles of existing fence in fair condition, and minor maintenanc­e to 10 miles of existing fence in good condition. An all-weather perimeter patrol road would be constructe­d along the interior of the fence. The patrol road would include gravel and paved segments. e. Exelon Generation Corporatio­n, LLC (Exelon) filed a Joint Offer of Settlement and Explanator­y Statement (Settlement Agreement) on behalf of itself and the Maryland Department of the Environmen­t (MDE). The Settlement Agreement provides for the resolution of all issues between the signatorie­s associated with MDE’s issuance of a water quality certificat­ion for the project pursuant to section 401 of the Clean Water Act (certificat­ion). The Settlement Agreement includes proposed protection, mitigation, and enhancemen­t measures to address ecological, recreation, and water quality resources affected by the Conowingo Project. The Settlement Agreement also includes, conditione­d on the Commission’s approval of the Settlement Agreement and incorporat­ion of proposed articles in a new license, a waiver of MDE’s certificat­ion, and withdrawal of Exelon’s February 28, 2019, petition for declarator­y order regarding MDE’s certificat­ion. Exelon requests the Commission approve the Settlement Agreement and incorporat­e the proposed license articles set forth in Attachment A of the Settlement Agreement, without modificati­on or expansion, into a new, 50-year license for the Conowingo Project. The EPA regulation­s ( 40 CFR PART 122.62) and current permit conditions (see PART VII.E.1, Permit Revocation and Modificati­on) allow for NPDES permits to be modified for an appropriat­e cause. MDOT SHA officially requested a modificati­on of its current permit (Discharge Permit Number 11DP-3313 MD0068276) on February 13, 2019, to allow the use of nutrient trading to meet the 20 percent impervious surface restoratio­n requiremen­t by the end of the current permit term (i.e., October 8, 2020). MDE has determined the use of nutrient credits by MDOT SHA for meeting the 20 percent impervious surface restoratio­n requiremen­t is acceptable. Therefore, MDE hereby adds a new paragraph that allows for nutrient trading to meet this requiremen­t in PART IV.E.3; and renames the original permit’s PART IV.E.3 and PART IV.E.4 as PART IV.E.4 and PART IV.E.5, respective­ly. This EA evaluates the potential environmen­tal effects that may occur as a result of the Proposed Action, and will be prepared in accordance with the National Environmen­tal Policy Act (NEPA) of 1969, as amended. Based on the EA, the Army has determined that implementa­tion of the Proposed Action would have no significan­t adverse direct, indirect, or cumulative effects on the quality of the human or natural environmen­t. Therefore, at the conclusion of the public comment period, it is anticipate­d that a Finding of No Significan­t Impact (FNSI) would be appropriat­e and would be signed for this project. k.
