As states legalize marijuana, on-the-water offenses increase; it’s illegal federally, so the Coasties can still bust you. Currently, there are breathalyzer tests under development for boaters, but field sobriety tests also tend to reveal other chemical influences. There is currently no legal threshold for THC levels in the blood, meaning any amount can result in a criminal BUI offense, particularly in the instance of an accident.
