Court & abortion
Abortion tears our social fabric more than any other issue and the rends are magnified when Americans misunderstand the meaning of judicial review. The executive and legislative branches of our republic are political, but the judicial branch is not. Those who judge are specifically enjoined from acting in a political manner; they are charged with reviewing contentious laws according to constitutional standards. Abortion is one such contentious issue and should not be decided by popular vote until the Constitution is amended on one side of the issue or the other or Congress passes a law that passes judicial review.
