81-year-old man killed in apparent random assault

A man has been arrested, charged with murder

SAN JOSE >> An 81-year-old man has died from injuries he suffered in an assault that occurred nearly two weeks earlier in a residentia­l neighborho­od in South San Jose, authoritie­s said.

A police report suggests that the deadly attack might have happened at random, with no connection between the victim and the suspect, now jailed and charged with murder.

Allen Douglas Dournaee, a San Jose resident, died April 8 at a local hospital, according to San Jose police and the Santa Clara County Medical ExaminerCo­roner's Office.

The attack was reported at 8:11 p.m. March 27 near Avenida Grande and Via Romera, in front of Los Paseos Elementary school, police said.

Responding officers found Dournaee with severe head injuries and he was rushed to the hospital. Court documents show that the injuries caused Dournaee to fall into a coma.

A police report states that 32-year-old Amiel Joey Mirador was walking on the street, apparently intoxicate­d. Investigat­ors, citing home security footage from the area, allege that Dournaee was also walking in the area and shined a flashlight toward Mirador, then turned away from him.

Moments later, Mirador reportedly ran up to Dournaee from behind and punched him as many as two times in the back of the head, knocking Dournaee to the ground. With the elderly man lying face down, Mirador is reportedly captured punching Dournaee once more.

Mirador was one of the people who called 911 to report the victim's injuries, and in an initial statement told police that he discovered the injured man when he tripped over Dournaee lying in the street.

Mirador was arrested the same night, and has since been held without bail in the Santa Clara County Main Jail, and his primary criminal charge was expected to be amended from assault to murder after Dournaee died. Mirador has also been charged with elder abuse.

The death marked the city's sixth homicide of the year, a total that increased to seven early April9 after a man was found suffering from gunshot injuries near Meridian Way and Pedro Street on the northern edges of Willow Glen near Southwest Expressway and Interstate 280.

The victim was taken to a hospital, where he died, police said.

He has not been publicly named pending his formal identifica­tion and notificati­on of his next of kin by the coroner's office.
