Longmont man accused of assault
A Longmont man has been arrested after reportedly attacking another man with a baseball bat last week.
Cody Villarose, 30, was arrested Monday on suspicion of first-degree assault and felony menacing and remains in custody on $10,000 bond as he awaits a formal filing of charges Wednesday.
According to an arrest affidavit, Longmont police were called to the area of Ken Pratt Boulevard and 119th Avenue on May 11 for a report of an assault.
Officers found a man on the ground saying he had just been assaulted with a baseball bat while riding his bike. The man was taken to the hospital, where he was diagnosed with a fracture on his right leg, a broken ankle and a contusion to his left hand.
The man told police he had been at St. Vrain Greenway when he overheard a group of homeless men talking about being kicked out of a camp in the area. The man said he laughed at the group, which angered one of the men.
According to the affidavit, the man said he began riding away on a bicycle when the suspect then took out a metal baseball bat and began hitting his ankles from behind. The man said this caused him to fall, and the suspect began to hit him with the bat on the ground.
The man said he used the bike to stand up and get away as the suspect yelled, “I’ll (expletive) kill you.”
According to police, the man said he had seen the suspect before and knew the mother of his child.
Through the woman, police were able to identify the suspect as Villarosa. The woman also showed police messages she received from Villarosa that read, “I might be getting arrested,” “I think I’m definitely getting arrested,” and another calling the named victim “a snitch.”
Police looking back through body camera footage from responding officers saw they had spoken to a group of people, including Villarosa, about whether they saw the incident. Based on the time stamp on the video and the time stamps on the texts, the video footage shows Villarosa sending the woman the texts even though at that point the officer had not yet named the victim of the assault.
The named victim then also picked out Villarosa from a photo lineup.
Villarosa has a criminal history that includes convictions for attempted second-degree assault, theft, third-degree assault, criminal possession of documents and violation of a protection order.
