Teen waives in Darby double shooting fatal to 1
A 15-year-old Darby boy charged in the fatal shooting of another teenager inside a Darby convenience store in February waived his preliminary hearing before Magisterial District Judge Lee Cullen Grimes.
Samir H. Austin is charged with criminal homicide, murder in the first and third degree, aggravated assault, reckless endangerment and firearms offenses for the Feb. 5 shooting at the Darby Quick Mart on the 400 block of Main Street that also wounded another 18-year-old.
Austin, represented by defense counsel Gina A. Amoriello, is being held without bail at the county jail in Concord awaiting formal arraignment at the Delaware County Courthouse in Media on May 15. Assistant District Attorney Beth Ramos is prosecuting.
Police previously said Austin was exiting the store with a friend about 4 p.m. when he turned around and fired two shots from an untraceable ghost gun, striking a 15-yearold victim twice in the chest. One of the bullets passed through the 15-year-old and struck the 18-yearold behind him.
The 15-year-old was a student at the William Penn School District. No motive is known for the shooting.
Austin was in police custody within 16 hours.
Darby Police Chief Joseph Gabe said at a press conference announcing the charges that the arrest was a team effort with his department, county detectives and other departments working together.
Delaware County District Attorney Jack Stollsteimer also credited the quick work of Darby police in applying a tourniquet to the 18-year-old, saving him.
