BOY, 15, ACCEPTS GUILT IN WARREN FATAL CRASH

— A 15-year-old Montgomery LEBANON County boy was to be returned to Montgomery County after accepting his guilt on Monday in a fatal May crash in Warren County.
Judge Joe Kirby ordered the boy, Hosny Mousa, to be transferred to Montgomery County after he accepted responsibility - the juvenile court equivalent of pleading guilty - to aggravated vehicular homicide, vehicular homicide, speeding and driving without an operator’s license during a hearing in Warren County Juvenile Court.
Over the prosecutor’s objections, Kirby ruled the case should be sent for sentencing in Montgomery County, where Mousa lives and is already on probation for driving without an operator’s license several weeks after the crash resulting in the death of Noah Theiss, 17, of Franklin Twp., on May 25 on a winding stretch of Springboro Road.
“The objective is to treat a child in their home county,” the judge said.
Before transferring Mousa, Kirby said he was “stunned” to learn the boy drove after the fatal crash.
“That is just shameful,” Kirby said. “It is just tragic what you have done.”
Theiss lived in Franklin Twp. and attended Bishop Fenwick High School.
Three homemade wooden crosses and flowers mark a roadside memorial to Theiss at the crash site on the south side of the road, just east of the Sycamore Preserve Park southeast of Springboro.
He was pronounced dead at the scene, just east of where Red Lion-Lytle Road runs into Springboro Road and heads north toward Springboro.
He died in one of a series of tragic fatal crashes in the area involving teen victims, according to reports.
Mousa was initially detained after his arraignment on Sept. 13, more than three months after the crash, once the Ohio Highway Patrol submitted the accident reconstruction report.
“Hosny has always shown remorse for the death of his friend and for what he did to his friend’s family,” attorney Joshua Burns said.
Theiss was a passenger, not wearing a seatbelt, in his parents’ 2013 Honda when it crashed about 8:10 p.m., according to the Ohio Highway Patrol.
Theiss’ parents have not responded to requests for comment on this story.
Mousa was cited for driving at 67 mph in 55 mph zone, but Burns, indicated the speed was actually calculated at more than 80 mph.
Investigation determined the car was eastbound on Springboro Road, when it went off the right side of the roadway, striking a utility pole and rolling over several times.
Mousa and a rear passenger were treated and released after the crash.
After the hearing, Warren County Prosecutor David Fornshell said he would have preferred the case stay in Warren County.
“In my opinion, this is where he should fully have to answer for killing his passenger through his reckless actions,” he said.
