2nd competency exam ordered for accused teen

Dayton man facing charges related to armed robbery.

A second competency exam has been ordered for a Dayton teen facing multiple charges after a 2018 Miamisburg armed robbery that authoritie­s said he was fleeing before being wounded by police.

Charles Vincent Ashford, 18, has undergone one evaluation since a not guilty by reason of insanity plea was entered for him. But a judge has ordered a second one at the request of his attorney, court records show.

“There is a question as to the present competence of the defendant ... and as he can counsel with his attorney regarding a defense, and further, as to the defendant’s sanity at the time of the alleged offense,” according to a filing by Montgomery County Common Pleas Judge Barbara Gorman.

The report on Ashford’s first competency exam was filed last month but has not been made public, court records show.

Ashford was shot Feb. 5, 2018, at what has been described as a chaotic, life-threatenin­g scene that drew several law enforcemen­t agencies to the Ohio 725/Interstate 75 interchang­e. Court records show Ashford fired a gun at police and claimed to be an undercover FBI agent.

The insanity plea was entered in January about two weeks before Ashford was set for trial. The charges against him include seven counts of aggravated robbery, one count of felonious assault on a police officer, discharge of a firearm on or near prohibited premises, and impersonat­ing a peace officer, records show.

The report on the second examinatio­n should state whether or not Ashford is competent to stand trial, according to Gorman’s order.

If there is a finding of incompeten­ce, the report should state Ashford’s current mental status. A finding of whether the defendant is competent should include an opinion of his sanity at the time of the alleged offenses, the ruling states.

All of the charges accuse the teen of using a gun. Ashford is being held in juvenile detention on a $500,000 bond.
