Daycare sex abuse inquiry continuing

Prosecutor­s are awaiting additional evidence to determine whether charges will come from the investigat­ion into two reports of possible sexual abuse at a Dayton daycare.

“The prosecutor’s office has been consulting with Dayton police,” said Greg Flannagan, spokesman for the Montgomery County Prosecutor’s Office.

Pat’s Care Away from Home, 1402 W. Third St., had its license suspended by the state last month following the first accusation.

A sign posted to the child care center’s door announced its temporary closure, and when reached, the business declined further comment.

The Ohio Department of Jobs and Family Services received a complaint Jan. 13 involving inappropri­ate touching between an adult and child, said Bret Crow, spokesman for the Ohio Department of Jobs and Family Services. The state suspended Pat’s Care Away from Home’s license three days later following an inspection that revealed the child care center had a serious risk violation when a “staff member did not protect infant from a serious injury,” the state inspection read.

The complaint to the state came two days after Dayton police were contacted by a social worker at Dayton Children’s Hospital about possible sexual abuse involving a 6-month-old girl at the daycare, according to police records. The social worker told police dispatcher­s the girl was injured.

The social worker said the possible abuse happened at the daycare, but was not able to provide any further informatio­n about possible people involved.

A separate police memo report filed Jan. 30 shows the Dayton Police Department responded to the daycare after a social worker wanted to report another possible case of sexual abuse possibly involving a 3-yearold boy.

Dayton police have not commented on either case. videos, including child pornograph­y, in his home.

Gregory Wagner, 67, was initially arrested after an in-home visit yielded drugs and alcohol. An investigat­ion revealed the other explicit materials, phones and computer.

His initial parole violation arrest was in March 2017. However, Wagner was arrested Friday for eight sex-related felony charges — seven charges of child porn and one of gross sexual imposition.

Wagner has charges in two counties. In Miami County, he was sentenced to 18 months for sexual imposition in 1991, sentenced to 18 months for domestic violence in 1996, convicted of sexual imposition in 1997 and sentenced to five years in prison for five counts of pandering child pornograph­y in 2007.

He was also convicted of several charges in Auglaize County. Jail records show Wagner was arrested on charges of OVI, drug abuse and improper handling of a firearm in a motor vehicle. He was released from the Auglaize County Jail in August 2018.

Wagner will be in the Miami County Courthouse today.
