New court date set in murder case
A man accused of killing a Kettering insurance agent wants evidence in his case barred from use.
Joshua Dehart, 37, is due back in court on July 7 for a motion to suppress hearing.
Dehart is facing charges in Montgomery County Common Pleas Court of aggravated murder, murder, aggravated burglary and two counts of felonious assault.
He is accused of killing Barton Wilson, 74, on March 9. Wilson died of blunt force trauma due to multiple wounds to the back of the head, Montgomery County Coroner Dr. Kent Harshbarger said. He was killed inside his business, Barton Wilson Insurance on Wilmington Pike in Kettering.
Police said Dehart was a former tenant of Wilson’s and previously worked as a maintenance man for him. Wilson owned rental properties.
In a motion to suppress evidence filed in the case, Dehart, through his attorney, is asking the court to bar the use of statements Dehart made to the police and any and all evidence seized from his residence.
“All evidence obtained was the product of a search and seizure conducted in violation of the defendant’s rights under the United States Constitution and the Ohio Constitution,” the motion says.
Kettering police identified Dehart as the suspect through witness statements, video surveillance and physical evidence, county Prosecutor Mat Heck Jr. stated in a release. Investigators also said they found DNA at the crime scene.
