Still no trial date forMadison Twp. man indicted on porn charges
Suspect has pleaded not guilty to 101 charges of child pornography.
A year after a Madison Twp. man was indicted on 101 charges of child pornography, a trial date has not been set.
But a hearing on a defense motion filed seven months ago is scheduled to happen in 2021.
Trevor Fraley, 24, of Dickey Road, was indicted on Nov. 22, 2019, on multiple counts of pandering sexually orientedmatter involving a child and illegal use of a minor in nudity-oriented material or performance.
Fraley has pleaded not guilty to all charges. Fraley remains free on $500,000 bond, and he was ordered towear aGPS monitor, have no contact with any children, including his own, to have no internet access and to report twice per week to pretrial services.
In June, Fraley’s attorney, Chris Pagan, requested a change in that bond to allow him to work so he can pay his attorney. Pagan filed a motion to modify bond to permit Fraley to travel in more surrounding counties.
Fraley’s family ownsa Butler County trucking company, and he can work for thatcompany, but it requires traveling through Preble, Montgomery, Greene, Miami and Clark counties to get to a customer in Springfield, according to Pagan.
Theprosecution requested Fraleybe requiredtoprovide awork order and travel itinerary that includes location andstops along thewayprior tothe trips so hismovements and purpose can be monitored and verified.
Judge Michael Oster Jr. grantedthebondchangeand the prosecution’s request on monitoring.
InMarch, Pagan also filed a motion to suppress evidence, including items taken fromaMiddletownhomeon Crawford Street, including cellphone, computers and other electronic devices.
OnMonday, Fraleywas not in court for a pre-trial hearing concerning the suppression motion because he is in coronavirus quarantine, according to court officials. Oster scheduled a hearing for Jan. 21 on the motion to suppress.
Pagan argued some of the search warrants were not properly signedby themagistrate and relied on an uncorroborated statement from a woman with a drug addiction and a case through ButlerCountyChildrenServices.
A computer believed to belong to Fraley contained “a very large amount of child pornography — over 1,200 videos depicting children engaged in sexual activity, much of which has been duplicated by defendant’s backing up the videos from his phone to his computer. The most recent unidentified backup occurred on Oct. 29 (in 2019),” Assistant Butler County Prosecutor KellyHeile said in court documents.
The motion also sayssome of theimages allegedly traced to Fraley’s digital payment service include sex acts involving toddler-aged children. One of the imagesmay have been taken at a previous residence shared by a witness and Fraley, according to Heile.
