On September 14, 2017, an Affidavit for Collection of Small Estate by Distributee was filed with respect to the Estate of Grady Palmer, deceased, with the clerk of the probate division of the Circuit Court of Union County, Arkansas, under Ark. Code Ann. § 28-41-101. The legal description of all real property listed in the Affidavit is described below: Commencing at the Southwest corner of the Northeast Quarter of the Southeast Quarter of Section 24 Township 18 South Range 17 West and thence South 89° 55’ 04” East 495.00 feet for a point of beginning; thence North 2° 01’ 09” West 396.32 feet; thence South 89°55’04” East 280.00 feet; thence South 2°01’09” East 396.32 feet; thence North 89°55’04” West 280.00 feet to the point of beginning containing 2.546 acres more or less, however, subject to all easements. AND THE STATE OF ARKANSAS, DEPARTMENT OF FINANCE & ADMINISTRATION DEFENDANTS NOTICE OF COMMISSIONER'S SALE NOTICE IS HEREBY GIVEN that pursuant to the authority and directions contained in a Consent and Default Foreclosure Decree in the Sixth Division of the Circuit Court of Union County, Arkansas, made on January 8, 2007 and entered on January 16, 2007, and a Summary Judgment made and entered on September 18, 2017, in a certain case (No. CV 2006-385-6) pending Hara Weaver, Plaintiff, and Katrina Gosvenor, Administrator of the Estate of James Fergus Brown, Deceased, et al, Defendants, the undersigned, as Commissioner of said Court, will offer for sale at public venue, to the highest bidder at the East Front Door of the Union County Courthouse in which said Court is held, in the City of El Dorado, Arkansas, and in the County of Union, within the hours prescribed by law for judicial sales, on Tuesday, October 10, 2017 at 10:00 a.m., the following described real estate in Union County, Arkansas, towit:

TRACT: Commencing at the Southwest Corner of the SE 1/4 of the SW 1/4 of Section 9, Township 18 South, Range 15 West, and running 518 feet East for the Point of Beginning; run thence North 19 degrees East along and with an old net wire fence 488 feet; thence South 88 degrees East 119 feet; thence South 19 degrees West or parallel with the West old fence line 488 feet; thence North 88 degrees West 119 feet to the Point of Beginning.
AND LESS AND EXCEPT THE FOLLOWING DESCRIBED RIGHT-OF-WAY: A 25 foot right-of-way which enters said tract near the Southeast Corner of said property proceeding approximately parallel to an existing railroad right-of-way and existing property near the Northeastern Corner of said tract, being approximately 1750 feet in length and containing approximately 1 acre, more or less.
By Order of this Court the said Consent and Default Foreclosure Decree entered against James F. Brown (now deceased) was assigned to Hara Weaver as the Plaintiff on April 10, 2007 and entered on April 13, 2007. That as of September 18, 2017, the balance owed on the judgment was in the amount of $57,650.55.
TERMS OF SALE: On a credit of three (3) months, the purchaser being required to execute a bond, as required by law and the Decree and Order of said Court in said cause, with approved security, and a lien being retained on the premises sold to secure the payment of the purchase money. In lieu of a surety bond, the purchaser may post a 20% cash bond, which will be forfeited in the event of failure to pay for the property within 90 days, in which event the Commissioner will resell the property.
