Trial set for man accused of sexual assault, indecency
An El Dorado man facing charges including five counts of sexual indecency with a child, second-degree sexual assault and failure to comply with registration requirements is set to go to trial starting Monday, March 27.
Christian Taylor Evans, 30, was arrested in December 2021. According to court records, Union County Sheriff’s Office deputies responded to a report of “a man exposing himself to a child” at a residence in the Parkers Chapel area.
Witnesses on the scene told investigators that a minor male showed his mother a phone video of a neighbor — allegedly Evans — exposing himself to four neighborhood girls in his home and forcing one of the girls to touch him.
The witnesses also showed the video to a deputy on the scene, according to court records, and told investigators that the video was taken by one of the girls.
After reviewing the evidence, deputies went to Evans’ residence and took him into custody.
Evans is a “level 2 registered sex offender out of Union County,” according to court records, and had also allegedly failed to report a change of address as required by sex offender registry requirements.
Evans is next scheduled to appear in court on March 16, at which time 13th Circuit, Division 6 Judge Spencer Singleton will likely make rulings on several pretrial defense motions to prohibit 404b evidence and to suppress digital evidence.
The motion to prohibit 404b evidence asks that prosecutors be disallowed from introducing evidence that the defendant has “previously committed bad acts, specifically that he has been convicted of a sex crime.”
The motion to suppress digital evidence maintains that evidence taken from Evans’ phone was taken without a search warrant and is thus a violation of the Fourth Amendment of the U.S. Constitution. The motion asks that all evidence allegedly taken from Evans’ phone be suppressed.
