Family of student who died in hazing incident seeks $225M from frat president

- By Cliff Pinckard

The family of a man who died during a hazing inci- dent at Bowling Green State University is suing a for- mer fraternity president, a Cleveland Heights resident, for $225 million, reports say.

Daylen Dunson was the president of Pi Kappa Alpha fraternity when Stone Foltz, 20, of Dela- ware, Ohio, attended an event on March 7, 2021, and drank the equivalent of about 40 shots of liquor. Foltz died three days later at ProMedica Toledo Hospital of alcohol poisoning.

In May 2022, Dunson pleaded guilty to reckless homicide, tampering with evidence, obstructing justice, obstructing official business, eight counts of misdemeanor hazing, and seven counts regarding pro- viding alcohol to under- age persons. In June 2022, Dunson was sentenced by a Wood County judge to 28 days of house arrest and three years of probation.

Several other men were convicted and sentenced last year in connection with Foltz’s death. The Pi Kappa Alpha was expelled from the BGSU campus. The univer- sity expelled three students and suspended 18 others, WTOL Channel 11 reports.

On Thursday, Foltz’s fam- ily asked a magistrate in Columbus to require Dun- son to pay the estate $225.3 million, WBNS Channel 10 reports. The family is asking for $1 million for each ounce of whiskey that Foltz drank, totaling $33.8 million. Another $191.5 million is for wrongful death and punitive damages, WBNS reports.

Dunson did not appear in court on Thursday and has ignored several previous summons to appear in civil court, WTOL reports.

“And, unsurprisingly, (Dunson is) not here to face the music today. He doesn’t care,” Jonathon Bond, the lawyer for the Foltz family, tells WTOL.

Reports say Dunson is the only person who hasn’t settled with the Foltz estate. BGSU and the other defendants have agreed to settlements totaling $11,431,000.
