Bill would cre­ate ‘in­de­cent as­sault’ charge

The pro­posed leg­is­la­tion would cre­ate the crim­i­nal of­fense of in­de­cent as­sault, which ap­plies to any touch­ing of the breast, but­tocks or gen­i­tals done with­out con­sent and with the in­tent to sex­u­ally arouse or grat­ify the of­fender.

Cur­rent law

Grop­ing is con­sid­ered a Class C mis­de­meanor, the low­est level of crim­i­nal of­fense in Texas, and is pun­ish­able by a fine of up to $500.

If leg­is­la­tion passes

Grop­ing would be el­e­vated to a Class A mis­de­meanor, with a max­i­mum penalty of a year in jail and a $4,000 fine.
