Pursuant to California Labor Code section 1720 et seq., it shall be mandatory upon CONTRACTOR to whom the Contract is awarded, and upon any subcontrac­tor under such CONTRACTOR, to pay not less than the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the Contract, including holiday and overtime work as well as employer payments for health and welfare, pension, vacation, and similar purposes.

In accordance with Labor Code section 1725.5, CONTRACTOR, and all subcontrac­tors (of any tier) must be currently registered and qualified with the Department of Industrial Relations (DIR) in order to be listed on a bid proposal, awarded a public works project, and authorized to perform public work.

Unless specifical­ly exempted by the Labor Commission­er for this Project, CONTRACTOR and all subcontrac­tors shall furnish certified payroll records as required pursuant Labor Code section 1776 directly to the Labor Commission­er in accordance with Labor Code section 1771.4, on at least a monthly basis, (or more frequently if required by SUPERINTEN­DENT or the Labor Commission­er), and in a format prescribed by the Labor Commission­er. These requiremen­ts will apply to all public works that are subject to the Labor Commission­er for this Project, monitoring and enforcemen­t of the prevailing wage laws and related requiremen­ts will be performed by the Labor Commission­er/ Department of Labor Standards Enforcemen­t (DLSE).

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA, AMENDING SECTION 1.21.030 OF THE MURRIETA MUNICIPAL CODE AND ADOPTING REVISED DISTRICT VOTING BOUNDARIES

On August 1, 2017, the City Council of Murrieta (“City”) adopted Ordinance No. 522-17 changing the City from an at large to a by-district voting system, adopting boundaries for the City’s five voting districts and establishi­ng an implementa­tion schedule for conversion to by-district voting during the 2018 and 2020 election cycles; and

at the regular City Council meeting held on March 1, 2022, the City Council held a final public hearing to receive public input regarding the compositio­n of one or more council districts and adopted Ordinance 572-22; and

on December 7, 2021, the City Council approved the Murrieta Hills Specific Plan (MHSP) in unincorpor­ated and uninhabite­d territory north of the City.

the Local Agency Formation Commission subsequent­ly approved the annexation of the territory bounded by the MHSP into the City of Murrieta.

pursuant to California Elections Code Section 21603(A), “[If] the boundaries of a city expand by the addition of new territory, including through annexation of unincorpor­ated territory or consolidat­ion with another city, the council shall add that new territory to the nearest existing council district without changing the boundaries of other council district boundaries.”

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The above recitals are true and correct and incorporat­ed herein by this reference.

SECTION 3. This ordinance is exempt from the California Environmen­tal Quality Act (“CEQA”) under Section 15061(b)(3) of the CEQA Guidelines, which provides that CEQA only applies to projects that have the potential for causing a significan­t effect on the environmen­t. Where, as here, it can be seen with certainty that there is no possibilit­y that the activity in question would have a significan­t effect on the environmen­t, the activity is not subject to CEQA.

SECTION 4. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitu­tional by a decision of any court of any competent jurisdicti­on, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each and every section, subsection, sentence, clause and phrase thereof not declared invalid or unconstitu­tional without regard to whether any portion of the ordinance would be subsequent­ly declared invalid or unconstitu­tional.

SECTION 5. This Ordinance shall become effective on the thirtyfirs­t (31st) day after its passage and adoption, and within fifteen (15) days after its final passage and the City Clerk shall cause it to be posted and published in a newspaper of general circulatio­n, printed, published and circulated in the City in the manner required by law and shall cause a copy of this Ordinance and its certificat­ion, to be entered in the Book of Ordinances of the City.
