Notice of public hearing of THE Cucamonga vally water District regarding proposed adoption of ordinance no. 20239-1 ESTABLISHI­NG RATES AND CHARGES FOR RECYCLED WATER SERVICE

NOTICE IS HEREBY GIVEN that pursuant to Article XIIID, Section 6 of the California Constituti­on, the Cucamonga Valley Water District (CVWD, or District) is proposing to adopt Ordinance No. 2023-9-1 to establish rates and charges for recycled water services. If you have questions regarding the type of services you receive from the District, please contact the District representa­tive at the contact informatio­n set forth below.

ON SEPTEMBER 26, 2023 THE BOARD OF DIRECTORS WILL HOLD A PUBLIC HEARING AT 5:00 P.M., OR AS SOON THEREAFTER AS PRACTICABL­E, AT 10440 ASHFORD STREET, RANCHO CUCAMONGA, CA 91730-2799 IN ORDER TO RECEIVE ORAL AND WRITTEN TESTIMONY REGARDING THE PROPOSED ORDINANCE.

The basis and reason for the proposed adjustment­s are to enable the District to recover increasing operating expenses, maintain services, and provide additional capital needs required to operate the District in a financiall­y prudent manner. Further details regarding the basis and reason for the proposed increases are available at the District offices located at the above-mentioned address and may be reviewed by any interested person. A copy of proposed Ordinance No. 2023-9-1 is posted and available for review at the above-mentioned address. A copy of the Ordinance is available by calling the District at (909) 987-2591 or at the District’s web site: www.cvwdwater.com.

At the time of the hearing, the Board will consider all protests. If written protests against the proposed rates are not presented by a majority of property owners and tenants directly responsibl­e for payment of charges, the Board will then be authorized to consider adoption of the Ordinance which would impose the charges.

Written protests may be submitted at the District offices in person or by mail at the above-mentioned address so long as they are received at the District offices prior to the conclusion of the public hearing. Any written protest must specify the rate or charge that is protested and must include your name, parcel number and/ or service address, your signature, and should be addressed to the attention of the Secretary of the Board. Summary of Ordinance

Ordinance No. 2023-9-1 would amend Chapter 4.16.110 of Title 5 – Recycled Water Regulation­s - of the District code as follows:

(a) The Recycled Water Meter Service Charges and Commodity Rates will be adjusted on October 1, 2023 and then increased incrementa­lly over the next 5 years through automatic annual rate increases;

(b) The IEUA Recycled Water Rate and IEUA Fixed Charge pass-through rates will be implemente­d on October 1, 2023 and charged for a 5-year period in order to pass through to its recycled water customers any amount of the IEUA recycled water commodity or fixed charges imposed on the District.
