Pursuant to the provisions of Section 1770-1777 of the Labor Code of the State of California, Director of the Department of Industrial Relations has ascertained the general prevailing rate of wages and employer payments for health and welfare, vacations, pension and similar purposes in the City in which the work is to be done. Information relative to the employment of apprentices shall be obtained from the Director of the Department of Industrial Relations, who is the Administrative Officer of the California Apprenticeship Council. The Contractor shall forfeit, as penalty to the Agency fifty dollars ($50.00) for laborers, workmen, or mechanics employed for each calendar day or portion thereof, if such laborer, workman or mechanic is paid less than the general prevailing rate of wages herein referred to and stipulated for any work done under the proposed contract, by him, or by any subcontractor under him, in violation of the provisions of the Labor Code and, in particular, Sections 1770 to 1781 inclusive. Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspection in the office of the Department of Industrial Relations, Division of Labor Statistics and Research. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, or religion will be also required.
Attention is directed to the provisions of Chapter 9, Division 3 of the Business and Professions Code requiring Contractors to be licensed. No proposal will be accepted from any Contractor unless they are licensed in accordance with the laws of this state. Contractor shall procure all permits incident to the lawful prosecution of the work. Further, the Labor Code of the State of California prohibits a Contractor from performing work on a public works project with a subcontractor who is ineligible pursuant to Section 1777.1 or 1777.7 of said code. The Contractor must possess a valid Contractor’s License issued by the Contractor’s State Board at the time the bid is submitted. The class of license shall be applicable to the work specified in the contract.
The successful bidder shall be licensed according to the provisions of the Business and Professional Code and shall possess a
license at the time this contract is awarded. The successful Contractor and his/her subcontractors will be required to possess business licenses from the City of Norco.

BIDDER understands that a bid is required for the entire work, that the quantities set forth in the Bid Schedule are to calculate total bid amount, and that final compensation under the contract will be based upon the actual quantities of work satisfactorily completed. The Contract Documents call for monthly progress payments based upon the City’s estimate of the percentage of work completed. The AGENCY will retain 5 percent of each progress payment as security for completion of the balance of the work. At the request and expense of the successful Bidder, the City of Norco will pay the amounts so retained upon compliance with the requirements of Government Code Section 4590 and the provisions of the Contract Documents pertaining to Substitution of Securities Bidders shall be responsible for verifying the issuance of addendums before submitting a bid. Pursuant to the California Environmental Quality Act (CEQA) the MDAQMD has determined that a Categorical Exemption (Class 8 – 14 Cal. Code Reg §15308) applies and has prepared a Notice of Exemption for this action.
NOTICE OF HEARING
that the Governing Board of the Mojave Desert Air Quality Management District (MDAQMD) will conduct a public hearing on January 22, 2024 at 10:00 A.M. to consider adoption of State Implementation Plan (SIP) Cleanup: Rescission of SCAQMD Rules 1108 – Cutback Asphalt; 1108.1 – Emulsified Asphalt; and 1120 – Asphalt Pavement Heaters as they appear in the SIP for the Blythe/ Palo Verde Valley portion of the MDAQMD and to acknowledgement that the currently SIP approved MDAQMD Rule 1103 - Cutback and Emulsified Asphalt adequately regulates the source category and is applicable through the jurisdiction of the MDAQMD.
NOTICE IS HEREBY GIVEN
will be conducted in the Governing Board Chambers located at the MDAQMD offices 14306 Park Avenue, Victorville, CA 92392-2310 where all interested persons may be present and be heard. Copies of this State Implementation Plan (SIP) Cleanup action, and the Staff Report are on file and may be obtained from the Executive Office Manager at the MDAQMD Offices. Written comments may be submitted to Brad Poiriez, Executive Director/apco at the above office address. Written comments should be received no later than January 21, 2024 to be considered. This action will continue the District’s SIP cleanup activities by requesting the removal of SCAQMD 1108, 1108.1 and 1120 and request acknowledgement that MDAQMD Rule 1103 is adequate for SIP purposes for this source category within the MDAQMD.
