Federal grand jury indictments announced

Johnathan Robert Havlick ha sido acusado de asesinato en segundo grado en territorio indio; por portar, usar, blandir y disparar un arma de fuego durante y en relación con un delito violento. Havlick, de 23 años, residente en Sapulpa y miembro de la Nación Cherokee, está acusado de disparar un arma de fuego y matar a Aaron Bendele en diciembre de 2023. El FBI y el departamento de policía de Sapulpa son las agencias de investigación.

Nelson Alexis Torres León, Roberto Quiroz López, José Isla-chávez, y Gerardo Martínez, Jr. están acusados de conspiración de drogas; posesión de fentanilo con intención de distribuir; posesión de heroína con intención de distribuir; mantenimiento de un local con drogas; posesión de heroína con intención de distribuir; y posesión de Fentanilo con intención de distribuir (supletoria). León, de 23 años, López, de 49 años, Isla-chávez, de 29 años, de nacionalidad mexicana, y Martínez, de 23 años, de Oklahoma City, están acusados de conspiración para el trádco de drogas. Además, León está acusado de posesión y distribución de fentanilo y heroína. López está acusado de posesión y distribución de heroína. Isla-chávez está acusado de posesión y distribución de fentanilo. León, Islachávez y López también están acusados de mantener una residencia para distribuir fentanilo y/o heroína. La administración para el control de drogas y el departamento de policía de Tulsa son las agencias de investigación.

Shelly Annette Mcelroy y Gary Don Mcelroy están acusados de conspiración de drogas; posesión de metanfetamina con la Intención de distribuir; posesión de Fentanilo con la Intención de distribuir; manipulación de un registro o documento. Shelly Mcelroy, de 52 años, y Gary Mcelroy, de 54 años, de Tulsa, están acusados de conspiración de drogas desde septiembre de 2023 hasta octubre de 2023. También se les acusa de posesión de metanfetamina y fentanilo con intención de distribución en Oct. 2023. Shelley Mcelroy también fue acusado de intentar manipular y borrar el contenido de un teléfono celular incautado como evidencia en Oct. 2023. Lance Douglas Roark está acusado de contacto sexual abusivo con un menor de 12 años en territorio indígena y agresión con intención de cometer abuso sexual agravado de un menor de 12 años en territorio indígena. Roark, de 43 años, de Bluejacket y miembro de la tribu Delaware, está acusado de mantener contacto sexual a sabiendas con la intención de cometer abuso sexual con agravantes con un menor de 12 años. El FBI y la odcina del Sheri!f del condado de Rogers son las agencias de investigación.

También hay dos individuos acusados de violaciones de inmigración. Benita Lorenzo Nicolás, de 45 años, de nacionalidad mexicana, está acusada de reingresar ilegalmente a los Estados Unidos después de haber sido expulsada en junio de 2017, en o cerca de Del Rio, Texas. Yair De Jesús Trejo-mendoza, de 35 años, de nacionalidad mexicana, está acusado de reingresar ilegalmente a los Estados Unidos después de haber sido expulsado en diciembre de 2015, en o cerca de Laredo, Texas. El servicio de inmigración y control de aduanas y operaciones de expulsión de Estados Unidos es la agencia investigadora en ambos casos.

Johnathan Robert Havlick has been charged with Second Degree Murder in Indian Country; Carrying, Using, Brandishing, and Discharging a Firearm During and in Relation to a Crime of Violence. Havlick, 23,

Sapulpa and a member of the Cherokee Nation, is charged with discharging a firearm and killing Aaron Bendele in Dec. 2023. The FBI and Sapulpa Police Department are the investigative agencies.

Nelson Alexis Torres Leon, Roberto Quiroz Lopez, Jose Islachavez, and Gerardo Martinez, Jr. are charged with Drug Conspiracy; Possession of Fentanyl with Intent to Distribute; Possession of Heroin with Intent to Distribute; Maintaining a Drug-involved Premises; Possession of Heroin with Intent to Distribute; and Possession of Fentanyl with Intent to Distribute (superseding). Leon, 23, Lopez, 49, Isla-chavez, 29, who are Mexican nationals, and Martinez, 23 from Oklahoma City, are each charged with drug conspiracy. Additionally, Leon is charged with possessing and distributing fentanyl and heroin. Lopez is charged with possessing and distributing heroin. Islachavez is charged with possessing and distributing fentanyl. Leon, Islachavez, and Lopez are also charged with maintaining a residence for distributing fentanyl and/or heroin. The Drug Enforcement Administration and Tulsa Police Department are the investigative agencies.

Shelly Annette Mcelroy and Gary Don Mcelroy are charged with Drug Conspiracy; Possession of Methamphetamine with Intent to Distribute; Possession of Fentanyl with Intent to Distribute; Tampering with a Record or Document. Shelly Mcelroy, 52, and Gary Mcelroy, 54 of Tulsa are charged with drug conspiracy from Sep. 2023 through Oct. 2023. They are also charged with possessing methamphetamine and fentanyl with intent to distribute in Oct. 2023. Shelley Mcelroy was also charged with attempting to tamper with and erase the contents of a cellular phone seized as evidence in Oct. 2023. The Drug Enforcement Administration and Tulsa Police Department are the investigative agencies.

Lance Douglas Roark is charged with Abusive Sexual Contact with a Minor Under 12 Years of Age in Indian Country and Assault with Intent to Commit Aggravated Sexual Abuse of a Minor under 12 Years of Age in Indian Country. Roark, 43, of Bluejacket and a member of the Delaware Tribe, is charged with knowingly engaging in sexual contact with the intent to commit aggravated sexual abuse with a child under 12 years old. The FBI and Rogers County Sherriff’s Office are the investigative agencies.

There are also two individuals charged with immigration violations. Benita Lorenzo Nicolas, 45, a Mexican national, is charged with unlawfully reentering the United States after having been removed in Jun. 2017, at or near Del Rio, Texas. Yair De Jesus Trejo-mendoza, 35, a Mexican national, is charged with unlawfully reentering the United States after having been removed in Dec. 2015, at or near Laredo, Texas. U.S. Immigration and Customs Enforcement and Removal Operations is the investigative agency in both cases.
