Special meeting set to discuss Centerra South legal issues
Loveland City Council will hold a special meeting at 7 p.m. on Wednesday to discuss legal issues that have arisen for the city in the wake of the decision to rescind its support of the Centerra South urban renewal plan.
Mayor Jacki Marsh called for the meeting in response to a lawsuit filed by Mcwhinney Real Estate Services on Tuesday.
According to the filings, Mcwhinney is seeking a temporary restraining order and injunction to prevent the city from moving forward with the reversal, citing breach of contract, unlawful termination of an urban renewal plan and unlawful procedure.
At the Nov. 21 regular meeting, the newly constituted Loveland City Council approved two motions introduced by Marsh during the new business portion of the meeting that rescinded the resolutions that created Centerra South and ratified its master finance agreement. City Council originally approved the resolutions in May and subsequently approved a major modification to the plan in October.
As stated on the agenda, City Council will meet on Wednesday to discuss the pending legal issues and potentially hire outside legal counsel to defend against the suit.
