Husband of daycare provider pleads not guilty to molesting girls

The husband of a Marysville daycare provider pleaded not guilty in Yuba County Superior Court on Friday to several child molestatio­n charges.

Luis Herrejon-ubias, 45, was arrested by the Marysville Police Department Wednesday after the mother of a five-year-old reported that her daughter had been inappropri­ately touched several times, according to a department press release.

Herrejon-ubias was charged Friday with two felony counts of lewd acts upon a child under 14, two felony counts of unlawful contact with a minor, and four special allegation­s (two for having more than one victim, and two for the victims being under the age of 14). The incidents range from April 2017 to August 2018.

His wife operates Leonor Family Child Care, in the 2100 block of Huston Street, and he is accused of molesting two young girls. The first was reported in August 2018, Yuba County Deputy District Attorney Shiloh Sorbello wrote in an email Friday.

“Charges were not filed immediatel­y, based on the initial reports, because we believed that proving the charges beyond a reasonable doubt would be unlikely without some corroborat­ion, given the young age of the girl,” Sorbello wrote. “However, the initial investigat­ion involved a forensic examinatio­n of the girl, and items that could contain evidence were sent to the CA Department of Justice, Bureau of Forensic Services, in Sacramento.”

The District Attorney’s Office received the results of the DOJ examinatio­n this week, which coincided with the second girl and her mother reporting the abuse. The five-yearold had told her mother about the touching the night before it was reported, according to the release.

The girl couldn’t provide a timeframe for when the touching happened, according to court documents, but she had not been to daycare this week. The girl identified

Edward J. Martin, 55, of the 1100 block of Arthur Street, Marysville, was arrested by the Yuba County Sheriff’s Office at 4 a.m. April 18 on North Beale Road on suspicion of threatenin­g to commit a crime. He was booked into Yuba County Jail.

Daniel R. Lueras, 19, of the 3100 block of Live Oak Boulevard, Yuba City, was arrested by the California Highway Patrol at 1:04 a.m. April 18 at Highway 99 on suspicion of being a felon in possession of a firearm, receiving known stolen property and carrying a concealed weapon. He was booked into Sutter County Jail.

Martin Gonzalez, 19, of the 1100 block of Mcmullen Avenue, Yuba City, was arrested by the California Highway Patrol at 1:04 a.m. April 18 at Highway 99 on suspicion of carrying a loaded firearm and receiving known stolen property. He was booked into Sutter County Jail.

Daniel A. Gabbard, 31, of the 1500 block of Freeman Street, Marysville, was arrested by the Yuba Herrejon-ubias in a photo lineup and during an interview with DA investigat­ors, said the touching had happened between five and 10 times before and that he would tell her he wanted to play with her while they were sitting in the play room, court documents show.

The California Department of Social Servicesco­mmunity Care Licensing Division was notified and will be conducting its own investigat­ion into the incident in regards to the facility’s license status. A search on the state’s online license base showed no results for the facility.

“If anyone has further informatio­n about the case or other potential victims, I would urge them to contact the Marysville Police Department,” Sorbello wrote. “The investigat­ion is ongoing. As a reminder, Mr. Herrejon-ubias, like every criminal defendant in his position, is presumed to be innocent unless and until the contrary is proven.”

County Sheriff’s Office at 12:52 a.m. April 18 in the 1700 block of Eighth Avenue on suspicion of a prohibited person in possession of a firearm and ammunition, unlawfully taking a vehicle and concealing a dirk or dagger. He was booked into Yuba County Jail.

Michael E. Jansen, 50, of Sacramento, was arrested by the Sutter County Sheriff’s Office at 11:30 p.m. April 17 in the 1300 block of Franklin Road on suspicion of being a felon in possession of ammunition, burglary, driving a car without consent, and attempted murder. He was booked into Sutter County Jail.

Russell V. Callahan, 27, homeless, Yuba City, was arrested by the Yuba City Police Department at 10:45 p.m. April 17 in the 800 block of Colusa Avenue on suspicion of carrying a dirk or dagger. He was booked into Sutter County Jail.

Paul S. Wagner, 35, of the 700 block of Almond Street, Yuba City, was arrested by the Yuba City Police

Department at 6:55 p.m. April 17 at Cooper Avenue on suspicion of obstructin­g or resisting arrest. He was booked into Sutter County Jail.

Alexandra S. Cook, 26, of the 1300 block of Amaranth Street, Plumas Lake, was arrested by the Yuba City Police Department at 3:09 p.m. April 18 at Plumas Street. She was booked into Sutter County Jail.

Amrit S. Dhaliwal, 21, of the 500 block of Diamond Pointe Way, Yuba City, was arrested by the California Highway Patrol April 18. He was booked into Sutter County Jail.

Kevin L. Prater, 48, of the 5600 block of Arboga Road, Marysville, was arrested by the Yuba City Police Department at 10:35 p.m. April 17 at Bridge Street. He was booked into Sutter County Jail.

Kenneth P. Jackson, 59, of Redwood City, was arrested by the California Highway Patrol at 7:32 p.m. April 17 at Archer Avenue. He was booked into Sutter County Jail.
