‘Grid Kid’ slay appeal

- Christina Carrega

LAWYERS FOR the convicted “Grid Kid Slayer” filed an appeal with a higher court requesting them to review a Brooklyn judge’s decision not to overturn their client’s criminal conviction.

John Giuca’s attorneys failed to convince Brooklyn Supreme Court Justice Danny Chun that he should have his murder conviction overturned and receive a new trial based off of unreliable testimony from one of the prosecutor’s witnesses.

Lawyer Mark Bederow accused the trial prosecutor of mishandling the 2005 case by not turning over possible impeachment documents regarding John Avitto, a cooperation witness, whom Giuca allegedly told of the shooting while in jail.

Giuca, 33, is currently serving 25 years to life in prison for the 2003 murder of Mark Fisher, a Fairfield University football player, in Ditmas Park. Avitto recanted his testimony and apologized to Giuca.
