Sex assault cop ID’d by teen, says her lawyer
THE BROOKLYN teen who accused two NYPD detectives of sexually assaulting her after cuffing her for a drug charge identified one of the officers in a photo lineup — but he still hasn’t been arrested, the victim’s lawyer said Saturday.
Attorney Michael David, who represents the 18-year-old (photo), said another witness to the teen’s arrest also identified the cop.
“She picked one of them out of a photo array within days of the incident. The ID was independently corroborated by a witness,” David said. In any other case, charges would have been brought already, the lawyer said.
“Why the courtesy? Because they’re cops?” he questioned.
Detectives Edward Martins and Richard Hall were stripped of their guns and shields after the teen said she was sexually assaulted following a drug arrest on Sept. 14.
The two undercover officers allegedly took the teen to a secluded spot about two blocks from the 60th Precinct stationhouse, where she says she was forced to perform a sex act on both cops. One of the detectives also raped her, her lawyer said.
NYPD Sgt. John Espey was also put on modified assignment for failing to supervise the two cops, authorities said.
Internal Affairs hadn’t interviewed the detectives as of Friday as they wait for Brooklyn prosecutors to finish their investigation, but Martins and Hall told colleagues that the sex was consensual, according to a high-ranking police source.
David said his client identified Detective Martins from the photo array — as did a friend who was with the teen when the cops cuffed her and took her away.
“He should be arrested already,” the lawyer said.
He also shot holes through the cops’ claim of consensual sex.
“She’s 18. She had never seen either of these guys before,” the attorney said, noting the detectives are in their 30s.
The NYPD declined to discuss specifics of the case.
“The matter is under active investigation by the Internal Affairs Bureau,” the department said.
