Council OKs law banning revenge porn

- Erin Durkin

REVENGE PORN will soon be a crime.

The City Council voted Thursday to ban posting naked pictures or explicit videos of someone online without their consent — a move to crack down on vengeful exes who try to get back at their former flames by spreading intimate images.

“More and more women, and occasionally men, have had their most private photos and videos shared publicly without their consent, with the intent to traumatize, humiliate or punish them,” said Councilman Rory Lancman (DQueens), who sponsored the bill. “This is the kind of legislation that shouldn’t be necessary, but unfortunately it is.”

The prohibition applies to photos or videos of another person who is nude or engaged in a sex act, posted online or shared by email or text, with the intent to cause emotional or financial harm.

It’s already illegal in New York State to secretly record sexual encounters — but it’s not a crime if explicit snaps are voluntarily shared with someone who later makes them public without the subject’s consent.

The new city crime, a misdemeanor, would be punishable by up to a year in jail and a $1,000 fine. It also applies to people who threaten to spread the images.

The bill, which the mayor is expected to sign, will also allow victims to sue for damages or an injunction to take down the offending images.
