$10M suit vs. NYCHA after ceiling cave-in

- Stephen Rex Brown and Rich Schapiro

A BROOKLYN couple who say they suffered serious injuries when the ceiling collapsed in their NYCHA apartment has filed a $10 million notice of claim against the city.

Daniel Jeter, 24, and his girlfriend, Tytannisha Moulterie, 22, accuse the city of negligence, carelessness and recklessness in the Jan. 13 cave-in at the family’s home in the Weeksville Gardens complex in Crown Heights.

The mishap left Jeter with injuries, including herniated and bulging discs. Moulterie suffered a herniated disc as well as injuries to her shoulders and neck, the claim filed by attorney Arkady Frekhtman says.

The pair were also exposed to mold, mildew and asbestos, the legal papers say.

The claim contains pictures of a gaping hole in the ceiling and debris strewn about the bedroom.

A spokeswoman for the city Law Department said “we will review the notice of claim.”

Days after the incident, the couple — along with Jeter’s parents, sister and autistic brother — found themselves living in a temporary, unfurnished apartment with no lights and a leaky toilet. The apartment has since been furnished.

“I don’t like the way it was handled and I want to do better by this family,” Mayor de Blasio said last month. A City Hall spokeswoman said the city was making repairs so the family could return to their old apartment.
