Slayer’s fam tantrum at sentencing

- BY ELLEN MOYNIHAN AND GRAHAM RAYMAN

A convicted murderer’s relatives went on a shameless rant about the fatally shot and pistol-whipped victim during a sentencing hearing Monday, screaming insults that threw a Queens courtroom into chaos.

Javyn McNish, 21, was being sentenced to 25 years to life by Judge Kenneth Holder for the vicious Dec. 2, 2017 slaying of Jerell Lewis, 20, outside the Ravenswood Houses in Astoria when the outburst erupted.

“Miss, your son was a piece of s—-. He was a notorious person,” yelled one of McNish’s female relatives as Lewis’ still-grieving mother, Cynthia Haynes, read an emotional victim impact statement. The screamer fled the courtroom before court officers could escort her out.

Authorities said the fatal dispute began when a friend of McNish told him he’d been in a fight with Lewis. McNish got a gun and fired three shots, hitting Lewis in the back and hand. Prosecutors said one bullet ripped into the spinal cord, immediately paralyzing him.

“He came out from behind that building from that side footpath and ambushed him,” said Queens prosecutor Andrea Medina. “When he’s immobilized and laying in the street, what does he do? He stands over him and pistol whips him, knocking out two of his teeth.”

Prosecutors said McNish was caught on video surveillance fleeing the scene and was found hiding in a nearby apartment moments after the shooting. The murder weapon, a 9mm semi-automatic pistol, was recovered in the apartment.

In her impact statement, Haynes told the court her murdered son was on his way to a baby shower before he was killed. “I pray you suffer every day of your life and never have peace,” she said. “I pray you never walk these streets again.”

Haynes also said the man who had been in a fistfight with her son beforehand had shot her other son.

The judge then delivered the hefty sentence.

“This is about the dumbest case I’ve seen in here,” Holder said. “Because you have no justification … This was filmed by 20 cameras… How stupid is that? What were you thinking? You have no right to be walking amongst the citizens.”

As McNish was being led away, his family yelled that they loved him.

“You’re a king!” one repeatedly shouted at the killer.

A woman who had earlier identified herself as McNish’s mother threw in one last jab as Lewis’ family walked out of court.

“Jerell Lewis died in the gutter like the animal he was,” the woman yelled, as court officers hustled the killer’s family into the hallway.

Lewis’ family thanked Holder after the sentencing.

“I feel like justice was served,” said Haynes of the sentence. “It could have been a bit longer.”
